LOCKPORT – A Niagara Falls man will be making his third trip to state prison, this time for firing a pistol at his girlfriend’s father on Pierce Avenue in the Falls March 13, 2013. The shots missed the target.

Donald L. Smith, 28, of LaSalle Avenue, was sentenced Thursday by State Supreme Court Justice Richard C. Kloch Sr. to five years behind bars and five years of post-release supervision for attempted second-degree criminal possession of a weapon and second-degree bail jumping. The latter charge pertained to Smith’s failure to show up for a Niagara Falls City Court date on domestic violence charges Nov. 28, 2012.

Smith’s prison resume includes a three-year sentence for fifth-degree criminal sale of a controlled substance in 2005 and an 18-month term for fifth-degree criminal possession of a controlled substance in 2008.
