Man jailed in Lockport assault case

LOCKPORT – Alan Roath, 51, of John Street, Lockport, was sentenced Monday to a year in Niagara County Jail for kicking another man in the head outside a Lockport bar Sept. 30. 2012.

Roath pleaded guilty Jan. 9 to third-degree assault in what his attorney, Thomas J. Eoannou, said was “a drug- and alcohol-infused argument over a woman.”

Victim Dennis Burkett said, “I stutter because of my injury. I was paralyzed on my right and I had to learn to talk again.” He added that he had “a 2 1/2-pound blood clot on my brain. … I almost died during my second surgery.”

Eoannou told County Judge Sara Sheldon Farkas that there was “a weeks-long delay between the incident and Mr. Burkett going to the hospital. … There was a huge issue regarding causation.”

As a result, Roath, who originally was charged with two felonies, was allowed to plead guilty to a misdemeanor.
