Buffalo man gets probation for driving drunk on sidewalk

A Buffalo man who was driving drunk on the sidewalk last year with his 8-year-old grandson in the front seat was placed on five years’ probation and fined $1,000 today.

Robert Johnson, 58, of Michigan Avenue, was arrested April 16 after police saw him driving onto the sidewalk in the 110 block of East Delavan Avenue about 9:20 p.m., prosecutors said. After his arrest, he registered a blood-alcohol level of 0.22 percent, almost three times the state’s legal limit.

Johnson was charged with two counts of aggravated driving while intoxicated with a child, endangering the welfare of a child, possession of alcohol in a vehicle and driving on the shoulder of the road. He pleaded guilty in January to aggravated DWI with a child, the highest count in the indictment, according to Erie County Assistant District Attorney Christopher Gresham.

State Supreme Court Justice John L. Michalski imposed the probation term on Johnson, who had faced a maximum prison sentence of four years.
