State Police said they charged Byron Brown with driving while intoxicated after pulling over a pickup truck seen swerving on the Kensington Expressway on Tuesday.

But it wasn’t Byron W. Brown, mayor of Buffalo.

It was Byron M. Brown, 49, who lives on Breckenridge Street.

A trooper pulled over the pickup at about 3 p.m. Tuesday after it was seen swerving between the three eastbound lanes. State Police said Brown showed signs of intoxication and failed roadside sobriety tests, but refused to perform a breath test to determine his blood-alcohol content.

Brown was issued several traffic tickets and is scheduled to appear Buffalo City Court. He also will face a hearing before the Department of Motor Vehicles on his refusal to take a breath test, State Police said.
