LOCKPORT – Phillip S. Muzzy Jr., 30, of Mackinaw Street, Buffalo, pleaded not guilty Thursday in Niagara County Court to a three-count indictment accusing him and another man of burglarizing a gas station and convenience store April 23 at River and Williams roads in Wheatfield.

Muzzy, a former Franklinville resident who is currently on a court-supervised drug treatment program in Buffalo, denied charges of third-degree burglary, petit larceny and third-degree criminal mischief. Also named in the indictment but not yet arraigned is James M. Trala, 26, also of Mackinaw Street.

Assistant District Attorney Laura T. Bittner said in court that the evidence in the case includes surveillance video from the Citgo station where the crime allegedly occurred.
