A motorist pulled over late Tuesday for violating the travel ban in Orchard Park was arrested on multiple charges – including aggravated driving while intoxicated, police reported Wednesday.
Marilyn Smith, 57, of Hanover, was stopped at about 11:15 p.m. Tuesday, while traveling south on Abbott Road. She reportedly told Lt. Jason Schiedel that she was driving back from Buffalo and knew there was a travel ban, but had gotten lost because of roadblocks.
Police said Smith was unable to stand on her own and was taken to the police station for field sobriety tests. She failed those tests and registered a blood-alcohol content of 0.22 on a breath test, police said.
She was charged with aggravated driving while intoxicated, because her BAC exceeded 0.18; unlicensed operation; a travel ban violation; driving with an open can of beer in her vehicle’s console; and a felony charge of criminal possession of a controlled substance, which police said was related to bags of crack cocaine found in her pocket.
Smith was held, pending arraignment in court.
