Judge rips Tuscarora man jailed for felony DWI

LOCKPORT – “You’re a deceptive human being,” Niagara County Judge Sara Sheldon Farkas said Friday as she cataloged the various efforts to evade probation rules attempted by Harry R. Jacobs III, an admitted drunken driver.

Farkas sentenced Jacobs to a year in the County Jail and $3,020 in fines and fees for felony driving while intoxicated. Jacobs, 38, of Chew Road, was arrested May 19, 2012, when his auto went into a ditch on Garlow Road on the Tuscarora Reservation; police found its rear end in the air with the wheels spinning.

On June 27, Farkas gave Jacobs six months of interim probation, but in July, a probation officer found a text message on Jacobs’ phone that said he “stopped for a drink.”

Farkas called that “very telling,” and also said Jacobs may have forged compliance forms for self-help meetings. He also wouldn’t admit ownership of a vehicle that was supposed to have an ignition interlock device installed on it. The judge said, Jacobs transferred the title to a cousin, but the vehicle was often parked at Jacobs’ home.
