A Buffalo man who attacked his downstairs neighbor with a hammer in the victim’s apartment, then stole cash and dozens of DVDs from his collection to get money to buy cocaine has received the maximum prison term.
State Supreme Court Justice Russell P. Buscaglia sentenced Eric Davis, 48, of Bailey Avenue, on Thursday to 15 years on his guilty plea to first-degree attempted assault.
Davis admitted repeatedly hitting the 54-year-old victim on the head on Sept. 4 after knocking on his door and asking him if he could use his microwave, according to Erie County Assistant District Attorney Michael P. Felicetta.
Over the next five days, Davis returned to the apartment to steal from the victim’s DVD collection, never summoning help for the victim, who suffered a stroke from his untreated injuries.
The victim was eventually discovered by his landlord.
Davis had previously been convicted of felony assault in 1994 and 2004, according to District Attorney Frank A. Sedita III.
