LOCKPORT – With the approval of the victim’s family, a Lockport man who had been charged with three counts of statutory rape was allowed to plead guilty to a misdemeanor Thursday in Niagara County Court.

Brandon A. Flatt, 21, of West Avenue, won’t have to register as a sex offender thanks to his plea to endangering the welfare of a child. The former special education student originally had been charged with three counts of third-degree rape for incidents with the underage girl in December 2012.

Assistant District Attorney Elizbeth R. Donatello said she thinks Flatt should be placed on probation and ordered to undergo the mental health counseling given to sex offenders. County Judge Sara Sheldon Farkas, who has the option of jailing Flatt for a year, said she will decide Feb. 25.
