Tuscarora man avoids prison time on marijuana charge

LOCKPORT – A Tuscarora Indian Reservation man who has been to state prison twice before avoided that fate on a felony marijuana charge Wednesday in Niagara County Court.

Joshua J. Rickard, 32, of Upper Mountain Road, was placed on five years’ probation by County Judge Matthew J. Murphy III for a guilty plea to a reduced charge of attempted second-degree criminal possession of marijuana.

The sentence came exactly one year after police raided Rickard’s home and seized 18 ounces of marijuana, two rifles and a shotgun.

Rickard’s two previous prison trips were for burglary convictions in 1999 and 2003. The first conviction followed an eight-day manhunt on the reservation after Rickard escaped from sheriff’s investigators in July 1998.
