NIAGARA FALLS – The city’s Zoning Board of Appeals on Tuesday night did not approve a variance request to allow a liquor store to be located at 424 24th St.

With about 50 people in attendance at the meeting in City Hall, the board’s 3-3 vote could not be broken because one member was absent from the meeting.

Faisel Haruna, who owns a convenience store across the street at 419 24th, needs a variance because the property is in a residential neighborhood.

Robert M. Restaino, Haruna’s attorney, said his client is considering his options, which include appealing the decision.
