Two-time robber draws seven-year maximum sentence

LOCKPORT – A Town of Lockport man who robbed two gas stations at knifepoint earlier this year was sentenced to 2 1/3 to seven years in state prison Monday by Niagara County Judge Matthew J. Murphy III.

Danny P. Merritt, 33, of Murphy Road, had pleaded guilty to stealing $65 from a Sunoco station at South Transit and Robinson roads May 5, and to robbing a clerk of $200 June 26 at the Sanborn Family mart and Valero gas station at routes 31 and 429 in Sanborn.

Murphy’s sentence was the maximum he could have imposed under terms of a plea deal Merritt accepted Aug. 20. He had pleaded guilty to third-degree robbery and attempted third-degree robbery.
