LOCKPORT – One of two Niagara Falls men charged with trying to steal copper pipe from a vacant home in that city April 6 was arraigned on a four-count indictment Friday in Niagara County Court.

Jose C. Rivera, 22, of Fourth Street, pleaded not guilty to third-degree burglary, third-degree criminal mischief, resisting arrest and attempted petit larceny.

Also indicted on the same charges but not yet arraigned was Alberto A. Torres-Roman, 18, of Michigan Avenue.

Police said a neighbor called 911 about intruders at the Seventh Street house, and officers caught one of the suspects at the scene and the other after a brief foot chase. About 150 feet of freshly cut copper pipe was found stacked in the basement as water leaked from damaged pipes, police reported at the time.
