Alden man convicted of home invasion and rape

An Alden man has been convicted on three felony charges stemming from a home invasion in Alden on Dec. 15, 2011, in which a 22-year-old woman was raped and sodomized, Erie County District Attorney Frank A. Sedita III announced Thursday.

Samuel Muscarella, 26, of Seabrook Drive, faces a maximum of 50 years to life in state prison when he appears for sentencing Oct. 14 before County Court Judge Kenneth F. Case. He was found guilty of two counts of predatory sexual assault and one count of first-degree burglary.

Muscarella already was serving a two-year sentence in Erie County Jail for his conviction on six counts of aggravated harassment for making more than 1,000 anonymous sexually harassing phone calls to several women during the three weeks preceding the home invasion.
