Bar owner pleads guilty to sales tax fraud

A 50-year-old Eden man who operated a Hamburg bar and restaurant pleaded guilty before State Supreme Court Justice John L. Michalski today to grand larceny in the second degree for failing to pay almost $73,000 in sales tax.

Luke Mumbach of 4315 Keller Road, the former operator of the Buffalo Street Grill at 61 Buffalo Street in Hamburg pleaded guilty to the highest charge he would have faced had he gone to trial.

Erie County District Attorney Frank A. Sedita III said Mumbach admitted he failed to make sales tax payments to the state of $72,592.61 while he operated the bar between June 2009 and August 31, 2011.

Sedita said Mumbach faces a maximum prison term of five to 15 years when he is sentenced Nov. 12.
