Guilty plea entered to felony DWI charge
LOCKPORT -- Chad A. Michalak, 26, of Crestwood Drive, pleaded guilty Friday in Niagara County Court to a felony count of driving while intoxicated.
Judge Sara Sheldon Sperrazza scheduled sentencing for Sept. 28. He was pulled over while allegedly speeding in Pendleton on Jan. 26 and also was originally charged with being under the influence of drugs.
Sexual assault suspect found unconscious
NORTH TONAWANDA -- The North Tonawanda police SWAT Team took an apartment door off its hinges to gain entry to a First Avenue apartment, where they found a sexual assault suspect unconscious after he had barricaded himself into the apartment Friday morning.
Jason Rivers, 27, was revived and taken to DeGraff Memorial Hospital, where he was listed in stable condition. Detectives are investigating the possibility that he had overdosed on drugs.
A woman described as a former girlfriend called police at 6:28 a.m. to report that she had been sexually assaulted by the man. She fled his apartment and told police that he had barricaded himself inside and that he might be suicidal, Lt. Robert Labushesky said.
The SWAT Team was called, and it had no success trying to talk with the man, before entering the apartment shortly after 8 a.m.
Officers charged Rivers with criminal sexual act and criminal contempt, for violating an order of protection, Labushesky said.
5 years' probation set in theft of aluminum
LOCKPORT -- A Garden Street man avoided jail time Friday in connection with the theft of $74,282 worth of aluminum from two area companies between September 2006 and January.
Niagara County Judge Peter L. Broderick placed Alan J. Herrick, 31, on five years' probation and ordered him to pay one-third of the restitution.
Two weeks ago, Dustin D. Cumbie, 20, of Sunset Drive, received the same sentence.
John T. Duboy, 26, of East Avenue, North Tonawanda, is awaiting sentencing.
All pleaded guilty to two counts of third-degree grand larceny in the thefts from Gasport Welding and Fabricating between September and December and from Brigham Concrete of Lockport in January.
Plea deal accepted in sex assault of teen
LOCKPORT -- A man who was charged with having sex with a 17-year-old girl while she was unconscious in a hospital bed faces up to eight years in prison under terms of a plea deal reached Friday in Niagara County Court.
Jonathan D. Bradley Sr., 28, of Main Street, Niagara Falls, pleaded guilty to first-degree sexual abuse and third-degree rape. Judge Sara Sheldon Sperrazza scheduled sentencing for Sept. 21.
The first charge stemmed from a Jan. 6 incident in Niagara Falls Memorial Medical Center with a woman who had recently given birth and had returned to the hospital to obtain medication for abdominal pain. Under the second charge, Bradley admitted having sex with the same woman in February 2005, when she 15 and thus underage.
