A Rushford man charged with murder is being held in Cattaraugus County Jail without bail after a preliminary hearing in Olean City Court last week.
Robert D. Secrist, 26, was charged with second-degree murder in a shooting Monday near the home of his ex-girlfriend Krista L. Brown, 27, of California Hill in the Town of Freedom.
Police said Secrist fired a single fatal shot from a .22-caliber rifle through a bedroom window at Brown's house, a shot that struck Tharin S. Jimerson, 33, of Jamestown, in the chest.
Jimerson was Brown's current boyfriend, police said, and Secrist is Brown's ex-boyfriend and the father of her two daughters.
The girls, ages 4 and 9, were outside in a tent during the shooting and apparently did not see what happened, police officials said.
Prior to the shooting, Brown returned from work after leaving Jimerson with the girls.
Following arraignment in Olean City Court, an order of protection was issued to restrict Secrist from contacting Brown and their children. Authorities said Jimerson had an order of protection against Secrist.
District Attorney Edward M. Sharkey is expected to take the case to a grand jury.
Public Defender Mark S. Williams expects to request bail for Secrist this week.
