Man pleads guilty in revenge killing

William Moore pleaded guilty Thursday to fatally shooting a Hempstead Avenue man a year after his victim and others beat up Moore and several of his friends in a street fight.

Moore, 31, of Eggert Road, has been jailed since his arrest shortly after the "payback" fatal shooting of David Costner Jr., 28, last July 11. He had been facing the start of a murder trial Monday but accepted a prosecution plea deal to a reduced charge of first-degree manslaughter.

Moore told Erie County Judge Timothy J. Drury he shot Costner outside the victim's home one year after the fight on Schreck Street. The judge accepted a prosecution demand to impose a prison term of at least 18 years. Sentencing was set for June 4.

Paul Gordon Dell, Moore's attorney, told the judge the victim's family had consented to the plea deal. Moore, who also had been charged with menacing a witness during the murder investigation, and several friends were beaten up by Costner and his friends, and Moore's car was damaged, during the July 2004 fight.
