Sentencing postponed in fatal DWI case
LOCKPORT -- Niagara County Judge Peter L. Broderick Sr. postponed sentencing last week for a drunken driver whose passenger died in a July 30 crash, after the defendant broke down in sobs as his lawyer was speaking.
Sentencing for Shawn A. Lysaght, 27, of 72nd Street, Niagara Falls, was put off until March 10.
"He's obviously emotionally distraught, and I'm not going to sentence him in that condition," Broderick said when Lysaght appeared before him Friday.
Lysaght pleaded guilty Nov. 16 to criminally negligent homicide and misdemeanor driving while intoxicated in the death of Leon LaRoche, 64, of Niagara Falls.
His car ran off a curve on Saunders Settlement Road, Lewiston, in the rain at about 75 mph and struck a utility pole, a parked van and a house.
Lysaght, who faces a maximum of four years in prison, said Nov. 16 that he was driving because LaRoche was more intoxicated than he was. Blood tests after the crash confirmed that.
Felony drug charges filed against teenager
LOCKPORT -- Joseph A. Tagg, 17, was charged with felony possession of marijuana Friday after a raid by the Niagara County Drug Task Force at his home in the 6300 block of Robinson Road.
Police said a "large quantity" of marijuana was found at the home Friday night but did not reveal the specific amount.
TV set, DVD system stolen from Falls home
NIAGARA FALLS -- A 32-inch flat-panel TV set was stolen after a 20th Street home was broken into Saturday night, police said.
The homeowner told police someone "popped" a door lock to enter the home after 9 p.m. Also taken was a DVD system. The stolen electronics were valued at $1,900.
Five teens arrested in theft of bicycle
NIAGARA FALLS -- A man chased several teenagers who stole his son's bicycle off the front porch of his 59th Street home at about 4:30 p.m. Saturday, police said.
The man gave descriptions to police, who recovered the bike, valued at $200, and arrested five teens. The teens will be petitioned to Niagara County Family Court, police said.
Lewiston resident faces DWI and fireworks charges
NIAGARA FALLS -- A Lewiston man initially arrested on a charge of driving while intoxicated at about 10:30 p.m. Saturday also was charged with illegal possession of fireworks.
Dennis P. Amsdill, 22, of Oneida Street, was stopped in the 1600 block of Walnut Avenue, where a search of his vehicle turned up the fireworks, police said. Amsdill also was charged with running a stop sign, police added.
Man beaten with pipe in Wheatfield trailer court
WHEATFIELD -- A 41-year-old Sanborn man told police he was beaten with a pipe late Saturday after an altercation with a River Road resident.
The victim, who refused treatment at the scene, told police he was assaulted inside the Lynch Park trailer court at about 11:40 p.m. The alleged attacker told authorities the victim had walked into his trailer without permission and "came after him."
Both men declined to press charges, police said.
