BRONX MAN FINED $1,000 FOR EVADING CIGARETTE TAX

A Bronx man who attempted to leave Cattaraugus County with more than 20,000 untaxed cigarettes he purchased received a one-year conditional discharge and was fined $1,000 recently in Cattaraugus County Court.

Alton Gardner Jr., 67, was sentenced by County Judge Larry M. Himelein for his guilty plea to attempt to evade or defeat cigarette tax.

District Attorney Edward M. Sharkey said Gardner was arrested Sept. 7 in Hinsdale and forfeited the cigarettes.

In other cases, two entered pleas and face sentencing in
July.

John W. Johnston, 55, of Mayville, pleaded guilty to driving while intoxicated on Feb. 28 in the City of Salamanca.

Rhonda J. White, 51, of Kill Buck, pleaded guilty to driving while intoxicated and failure to keep right on June 14 in Salamanca.
