OLEAN MAN GETS UP TO 3 YEARS IN DRUG CASE

An Olean man sentenced as a second felony offender Monday in Cattaraugus County Court faces up to three years in a state prison for drug possession.

Paul C. Spencer, 29, of North Sixth Street, was sentenced by Judge Larry M. Himelein to serve 1 1/2 to three years in prison for his guilty plea to third-degree criminal possession of marijuana. He was arrested Nov. 19 in Olean.

In other cases:

District Attorney Edward M. Sharkey said a former Olean man now serving a sentence in Lakeview Shock Correctional Facility also was sentenced.

Joseph P. Dempsey, 25, was sentenced to serve a one- to three-year sentence on top of the one he is now serving, for his conviction of second-degree bail jumping Sept. 27, when Dempsey failed to show up in Cattaraugus County Court.

Jason L. Wedlock, 26, of Allegany, was sentenced to five years' probation and 200 hours community service for his guilty plea to second-degree attempted criminal possession of marijuana July 28 in Allegany involving more than 16 ounces of marijuana.

Junior R. Duran, 36, of the Bronx, was sentenced to five years' probation for his guilty plea to attempted evading or defeating cigarette tax Dec. 7 in Olean involving 20,000 untaxed cigarettes.

Roberta A. Hoffman, 31, of Freedom, was sentenced to five years' probation and fined $3,000 for her guilty plea to driving while intoxicated Aug. 17, 2003, in Freedom.

Sharkey said several others entered pleas and face sentencing in upcoming weeks.

Jesse L. Schmidt, 20, of East Otto, pleaded guilty to fifth-degree criminal possession of a controlled substance and third-degree assault March 18, 2004, in Cattaraugus when he was found with Hydrocodone in his possession.

Christopher S. Tulwits, 21, of Arcade, pleaded guilty to third-degree criminal mischief March 6 when he caused damage of more than $250 to another person's property.

Orlando Encarnacion, 26, of the Bronx, pleaded guilty to attempting to evade cigarette tax Dec. 7 in Olean.

Chad K. Huber, 22, of Arcade, pleaded guilty to third-degree attempted burglary Oct. 26 in Machias.

Robert L. O'Hara, 55, of Franklinville pleaded guilty to driving while intoxicated Jan. 14 in Franklinville.

David S. Reimer, 18, of Cattaraugus, pleaded guilty to third-degree attempted criminal possession of a weapon and second-degree reckless endangerment Nov. 17 in Otto, when Reimer had a gun and put another person at risk.

Kieran N. Tome, 40, of Salamanca, pleaded guilty to driving while intoxicated and driving without a license Feb. 9 in Salamanca.
