CONVICTED KILLER ALSO SENTENCED IN DWI

James M. Burkhart, 44, of Hornell was sentenced Monday in Allegany County Court to 15 to 48 months in state prison.

Judge James E. Euken also fined him $1,000 and revoked his driver's license.

District Attorney Terrence M. Parker said Burkhart pleaded guilty Feb. 1 to felony driving while intoxicated, satisfying that count and a first-degree aggravated unlicensed operation charge in a March 17, 2004, indictment.

Burkhart, convicted in the beating death of a Hornell man last summer, is awaiting sentencing in Steuben County Court.
