A judge Monday signed an execution order for Stephen LaValle, who raped and fatally stabbed a high school teacher as she jogged near her home.
State Supreme Court Justice Michael Mullen scheduled LaValle's execution by lethal injection for Oct. 18.
LaValle, 32, becomes the fourth person on death row since the state reinstated the death penalty in 1995.
He was convicted of murdering Cynthia Quinn, 32, on May 31, 1998, in Medford.
But because of an automatic appeal, the verdict will not be carried out as scheduled.
Before signing the execution order, Mullen asked LaValle several questions, including, "Do you believe in God?" LaValle did not respond.
When asked whether he had anything to say, LaValle answered, "At this time, Your Honor, nothing."
