Tammie Giagios figured that she would be slapped with a fine when she pleaded guilty to failing to obtain a building permit for an above-ground pool in her yard.
Instead, she was sentenced to 30 days in jail, handcuffed and sent off to Chemung County Jail Wednesday as her husband, Michael, watched.
The couple did not know that they were in violation of the local building code when they installed the 27-foot pool beside their home in this town 45 miles west of Binghamton.
The couple's attorney, Marc Hutchison, immediately called the judge in the case, veteran Town Justice David Mulliner, in hopes of persuading him to suspend the sentence. He failed.
"It was 14 hours of hell," said Ms. Giagios, 28.
Hutchison filed an appeal Thursday morning with Chemung County Judge Peter C. Buckley, who suspended the sentence.
Ms. Giagios was released from jail Thursday.
