A Niagara Falls man has been accused of attempting to burglarize the Burger King on Military Road by sheriff's deputies who drove into the business' parking lot at 2:12 a.m. Tuesday on routine patrol.
Jarvis D. Elder, 19, of 13th Street was charged with third-degree burglary and second-degree criminal mischief after deputies said they located him at 2727 Military Road, less than two blocks from the crime scene.
The burglary was foiled after a deputy noticed a service window was broken out of the building and left on the ground.
As deputies investigated, they said they heard another window shatter on the other side of the business and saw a man running across Military Road.
Elder was treated in Newfane Inter-Community Memorial Hospital for cuts to his forearm, hand and fingers and was remanded to the Niagara County Jail in lieu of $5,000 bail after arraignment in Wheatfield Town Court.
