DRIVER IN CRASH REMAINS 'CRITICAL'

A Cheektowaga man who was seriously injured in a Port Colborne, Ont., traffic accident that killed his passenger remained in critical condition Sunday in Erie County Medical Center, hospital officials said.

Tim Churchill, 41, was attempting to turn left from Highway 3 onto Empire Road in his sport utility vehicle about 9:45 p.m. Friday when the vehicle was struck by a sports utility vehicle driven by Peter Scalzo, 26, of Port Colborne, Ontario provincial police said.

Churchill's passenger -- Mary Lou Comisso, 38, of Cheektowaga -- was pronounced dead at the scene. Churchill, Scalzo and Scalzo's passenger -- Heather Biggs, 18, of Welland, Ont. -- were all taken to Welland County General Hospital.

Churchill was transferred to the medical center. Ms. Biggs was treated and released. Scalzo was listed in stable condition Saturday after surgery. The Welland hospital refused to give his condition Sunday.
