COURT REJECTS U.S. SEIZURE OF BUILDING TIED TO DRUG DEAL

A court has ruled that the government had no right to seize a Brooklyn building where tenants were dealing drugs.

The 2nd U.S. Circuit Court of Appeals said Wednesday that the landlords should first have been given the right to defend themselves by showing they took steps in an attempt to curtail drug activity.

Instead, the appeals court said, the district judge improperly approved the seizure based only on a finding that the owners were aware that tenants were dealing drugs in their building.
