A permanent injunction barring Allegro Oil Co. of Frewsburg from producing gas or oil from 48 wells in Allegany and Cattaraugus counties has been obtained by the state Department of Environmental Conservation.
Acting Supreme Court Justice Peter R. Sprague made "permanent a temporary restraining order he issued earlier," DEC Commissioner Thomas C. Jorling said.
The DEC had charged that Allegro and its president, James R. Lee, violated operating rules on two leased tracts and barred further production from 12 wells in the Allegany County Town of Genesee and 36 wells in the Cattaraugus County Town of Carrollton until he posted $80,000 in financial security to guarantee the proper plugging of those wells and related environmental measures.
"Oil and gas must be produced in an environmentally sound and responsible
manner," Jorling said.
