TOWN OF TONAWANDA MAN CLEARED AFTER JURY TRIAL

A County Court jury Thursday took 15 minutes before clearing a Town of Tonawanda man of sodomy and unlawful imprisonment charges lodged by his former girlfriend.

After a three-day trial before Judge Joseph P. McCarthy, the jury found Brian Nitkowski, 28, of River Road, innocent.

Supported by testimony from the 17-year-old son of the former girlfriend, 38, Nitkowski testified the woman had sexual contact voluntarily with him while she was handcuffed in his flat last Feb. 4.

Under questioning by defense attorney Robert M. Goldstein, the son disputed his mother's claim that Nitkowski surprised her with the handcuffs when she went to his flat to discuss the end of their 3-month-old relationship.

The son said he, his mother and Nitkowski, a grocery store clerk, had "played" with the handcuffs in the defendant's flat on earlier occasions.

Under questioning from Jon E. Coughlan, chief of the district attorney's sex offense bureau, the woman testified Nitkowski handcuffed and sodomized her repeatedly after stating he wanted "revenge" for her decision to stop
dating him.
