DRIVER'S 1989 CONVICTION IN TROOPER'S DEATH UPHELD

The State Court of Appeals Thursday upheld the criminally negligent homicide conviction of Paul V. Spampanato, who struck and killed Trooper Alvin Kurdys while driving 90 mph on the State Thruway near Pembroke in September 1987.

Spampanato, 19, was found guilty a year ago in Genesee County Court of criminally negligent homicide in the death of Kurdys, 42, of Depew. Kurdys, a 17-year member of the State Police, was on radar patrol when he was struck and killed by Spampanato's sports car.

Spampanato, of Brockport, was sentenced to six months in jail and 250 hours of community service and was fined $2,500. He was also sentenced to five years' probation and the loss of driving privileges for five years.
